Caryan care ("we," "us," or "our") is committed to protecting your privacy and the confidentiality of your personal and health information. This Notice describes how we may use and disclose your protected health information ("PHI"), your rights regarding that information, and how to exercise those rights. What is Protected Health Information (PHI)? 

PHI is information that identifies you and relates to your past, present, or future physical or mental health or condition, the provision of health care to you, or payment for that care. Examples include your name, address, date of birth, medical records, treatment notes, payment history, and health insurance information.


How We May Use and Disclose Your PHI 

We may use or disclose your PHI without your written authorization in the following situations (subject to certain conditions and limitations):

  • For Treatment: To provide, coordinate, or manage your home care services, including sharing information with caregivers, nurses, physicians, or other health care providers involved in your care.
  • For Payment: To bill and collect payment for services from you, your insurance company, Medicare, Medicaid, or other payers.
  • For Health Care Operations: For quality assessment, staff training, compliance audits, business management, accreditation, licensing, and other operational activities.
  • To You or Your Personal Representative: To provide you (or your authorized representative) with access to your own records.
  • For Notification Purposes: To notify family members, close personal friends, or others involved in your care (unless you object).
  • Public Health Activities: As required by law for disease reporting, vital statistics, or public health emergencies.
  • Health Oversight Activities: To federal or state agencies for audits, investigations, or licensing.
  • Legal Requirements: In response to court orders, subpoenas, law enforcement requests, or to prevent serious threats to health/safety.
  • Research, Workers' Compensation, Coroners, Funeral Directors, Organ Donation, Specialized Government Functions: Under specific limited circumstances.
  • Marketing and Fundraising: We may contact you about health-related benefits/services or fundraising (you can opt out of certain communications).

For most other uses or disclosures (e.g., marketing that involves financial gain to us, sale of PHI, psychotherapy notes, or sharing with non-healthcare entities), we will obtain your written authorization. You may revoke authorization at any time in writing (except for actions already taken in reliance on it).


Your Rights Regarding Your PHI

You have the right to:

  • Receive a paper copy of this Notice upon request.
  • Inspect and obtain a copy of your PHI (with limited exceptions; we may charge reasonable fees).
  • Request amendments to your PHI if you believe it is inaccurate or incomplete.
  • Receive an accounting of disclosures of your PHI (for the prior 6 years, with some exceptions).
  • Request restrictions on certain uses/disclosures (we are not required to agree to all requests, but must honor restrictions on disclosures to health plans for paid-out-of-pocket services if you request it).
  • Request confidential communications (e.g., receive communications at an alternative address/phone).
  • File a complaint if you believe your privacy rights have been violated (with us or with the U.S. Department of Health and Human Services Office for Civil Rights). We will not retaliate against you for filing a complaint.


Our DutiesWe are required to:

  • Maintain the privacy of your PHI.
  • Provide you this Notice.
  • Abide by the terms of the current Notice.
  • Notify you following a breach of unsecured PHI (as required by law).

We reserve the right to change our privacy practices and update this Notice. The revised Notice will apply to all PHI we maintain. You can view the current Notice on our website at www.caryan.org/privacy or request a copy at any time.


Website Privacy (Non-Health Information)

When you visit our website, we may collect non-health personal information such as your IP address, browser type, pages visited, and referral sources (via cookies or analytics tools). This helps us improve our site and services. We do not sell this data. We use reasonable security measures to protect information transmitted through our site, but no method is 100% secure. Third-party links on our site have their own privacy policies—we are not responsible for them.
